How to Translate a Polish Divorce Decree for UK Visa Applications

A step-by-step guide to getting your Polish divorce decree (Orzeczenie o rozwodzie) translated and certified. It covers UK spouse visa, remarriage visa and settlement applications.

Do You Need to Translate Your Polish Divorce Decree?

Applying for a UK spouse visa after a divorce? If your decree comes from Poland, you need a certified English translation that meets UK Visas and Immigration (UKVI) rules. This applies if you or your former spouse got the divorce in Poland.

UKVI Requirement for Remarriage Visas

The Home Office needs proof that you are free to marry, or that your current marriage is valid. If your earlier marriage ended in a Polish divorce, you must send the decree (Orzeczenie o rozwodzie) with a certified English translation. This is a firm rule for spouse and partner visa applications where either person has been divorced.

What Makes a Polish Divorce Decree Translation UKVI-Compliant?

A UKVI-ready translation of your Polish divorce decree must have:

Complete Translation

Every word turned into English, including court stamps, judges' signatures and legal terms

Translator Certification

A signed statement that confirms the translator's Polish-English legal skills and the accuracy of the work

Translator Details

The certified translator's full name, qualifications, signature and contact details

Date of Translation

The date the translation was finished, shown clearly

Step-by-Step: How to Get Your Polish Divorce Decree Translated

1

Obtain Your Polish Divorce Decree

Ask the Polish court that granted your divorce for an official copy of the final decree (Orzeczenie o rozwodzie). From the UK, you can ask through:

  • The Polish court directly (Sąd Okręgowy or Sąd Rejonowy)
  • Polish Consulate in London, Manchester, or Edinburgh
  • Family members in Poland who can request on your behalf

Important: check that the decree says the divorce is final (prawomocne).

2

Upload Your Document

Upload a clear scan or photo of the decree to a UKVI-certified translation service. The system then:

  • Spots that it's in Polish
  • Counts the pages, usually 2-4
  • Gives you an instant quote for your spouse visa
3

Choose Your Delivery Speed

Select your preferred delivery option:

Standard (24 hours)£17.99/page

Best when you have time before your spouse visa deadline

  • A certification page with the translator's credentials
  • Copy of your original Polish divorce decree
  • The certified English translation, ready to send with your spouse visa

Why Divorce Decrees Are Required for UK Spouse Visas

Proving Freedom to Marry

The Home Office needs proof that both partners were free to marry on the wedding day. If either of you had married before, you must show a divorce decree that ends that marriage in law. Without it, UKVI can refuse your spouse visa.

When Divorce Decrees Are Required

Send your Polish divorce decree with a certified translation if:

  • You were married before and are now applying for a spouse visa with a new partner
  • Your new spouse was married before in Poland
  • You are applying for settlement after a spouse visa and you have been divorced

Multiple Divorces

Married more than once? Then you must send a divorce decree for EVERY earlier marriage, each with its own certified translation. That gives UKVI your full marital history.

Recognition of Polish Divorces in UK

The UK normally accepts Polish divorce decrees without extra legalisation. But a certified translation is still required for any UKVI application.

Common Questions About Polish Divorce Decree Translation

How much does it cost to translate a Polish divorce decree?

A standard UKVI-certified translation costs £17.99 per page with 24-hour delivery. The 8-hour rush service costs £29.99 per page. Most Polish divorce decrees run to 2-4 pages, so the standard service comes to £35.98-£71.96.

Do I need the final divorce decree or just the separation agreement?

You need the final divorce decree (Orzeczenie o rozwodzie), marked prawomocne, which means final. Separation agreements and interim orders are not enough for a UK spouse visa.

Can I translate the divorce decree myself if I speak Polish and English?

No. The Home Office does not accept a translation you did yourself, or one from a family member. That holds even if you're fluent in both languages. You must use a certified professional service whose certification meets UKVI standards.

Do I need to apostille my Polish divorce decree?

Usually not. The UK accepts Polish divorce decrees without an apostille. You DO still need a certified, UKVI-compliant translation. Ask your immigration adviser if your case is unusual.

What if my divorce was granted in Poland but I'm not Polish?

Your nationality makes no difference here. If a Polish court granted the divorce, you must translate the Polish decree.

How do I get a copy of my Polish divorce decree if I lost the original?

Contact the Polish court (Sąd) that granted the divorce. You can ask for a certified copy by post, through the Polish consulate, or online where that is offered. Allow 4-6 weeks.

Will the translation be accepted for all UK visa types?

Yes. UKVI-certified translations of Polish divorce decrees work for spouse visas, partner visas, settlement applications and British citizenship applications.

How Much Does Polish Divorce Decree Translation Cost?

A standard UKVI-certified translation starts at £17.99 per page. A 1-page Polish divorce decree costs £17.99. The usual 2-page decree costs £35.98. Rush 8-hour delivery starts at £29.99 per page. Traditional solicitors charge £80–£150 for the same UKVI-accepted certification. You save over 60% and get it back in 24 hours.

Why UKVI Rejects Polish Divorce Decree Translations

Here are the most common reasons UKVI rejects these translations, and how to avoid them:

Decree is not "prawomocne" (final and absolute)

UKVI needs the divorce to be final in law. Interim orders and separation agreements do not count. Check that your decree says it is prawomocne, which means final and binding, before you send it for translation.

Missing court stamps or judges' signatures in the translation

Polish divorce decrees carry several official stamps and signatures. All of them must be translated. A translation that skips the stamps will be rejected. Check that your service records every seal, stamp and signature.

Translation lacks proper certification statement

The translation needs a signed statement from the translator. It must confirm accuracy and give their qualifications, full contact details and the date. Leave out one part and UKVI can reject it. Use a service that knows UKVI rules.

Name discrepancy between translation and passport

Polish names with diacritics (ą, ę, ó, ś, ź, ż, ć, ń) must match your passport. If your passport shows "Łukasz", the translation must not say "Lukasz." Check the spelling against your travel documents before you apply.

Authentication and Apostille for Polish Divorce Decrees

Do You Need an Apostille?

For a UK visa, your Polish divorce decree does not need an apostille. The UK recognises Polish court judgments, and Home Office guidance since Brexit does not require an apostille on EU civil documents used in visa applications. A certified translation on its own is enough. One warning: if you use the decree for something else, such as remarrying in Poland or another country, that country may still ask for an apostille.

What is an Apostille?

An apostille is an international stamp under the Hague Convention. It confirms where a public document came from. In Poland, the Ministry of Foreign Affairs issues them. You do not need one for a UK visa. You may still want one if you plan to use the decree in several countries.

Obtaining a Polish Court Certified Copy (Odpis)

When you write to the Polish court, ask for a certified court copy (odpis). That version carries the court's official seal, and it is the one to translate. UKVI may refuse plain photocopies or scanned extracts with no court seal.

Divorce Granted Outside Poland but with Polish Nationals

Was the divorce granted in another EU country, with a Polish national involved? UKVI may then want proof that Poland recognises it. Check whether you need a Polish court recognition order (uznanie wyroku). That order needs a certified translation too.

Polish Court System: Understanding Divorce Documents

Poland runs a two-tier court system for civil cases. Once you know which court handled your divorce, you know which documents you need and where to ask for them.

Sąd Okręgowy (Regional Court)

In Poland, only the Sąd Okręgowy, the Regional Court, hears divorce cases (sprawy o rozwód). Many other countries deal with divorce in a lower family court. Poland has 45 Regional Courts (Sądy Okręgowe) spread across the country.

  • All divorce proceedings are filed here
  • Issues divorce decrees (Orzeczenie o rozwodzie)
  • May also issue decisions on custody, maintenance, and property division
  • The decree is marked prawomocne (legally binding) once the appeal window closes, or once all appeals are used up

Sąd Rejonowy (District Court)

The Sąd Rejonowy, or District Court, does not hear divorce cases. It still matters for divorce paperwork in these ways:

  • Handles separation (separacja) proceedings, which are distinct from divorce
  • Manages post-divorce enforcement matters (maintenance, access orders)
  • Holds civil registry records (akta stanu cywilnego) — a certified copy (odpis) of a marriage certificate from the Urząd Stanu Cywilnego (USC) may be needed alongside the divorce decree

Note: a separation order (separacja) is NOT a divorce. UKVI will not accept it as proof that a marriage has ended.

Types of Polish Divorce Documents

Orzeczenie o rozwodzie (Divorce Decree)

This is the main document. The Sąd Okręgowy issues it when the divorce case ends. It states that the marriage is dissolved. It may also settle custody, maintenance and use of the family home. UKVI needs it marked prawomocne, meaning final and binding. This is the document most UK visa applications ask for.

Wyrok rozwodowy (Divorce Judgement)

In everyday use, wyrok and orzeczenie o rozwodzie mean the same thing. When you write to the Polish court, ask for a certified copy of the wyrok with a note that it is prawomocne. UK visa staff accept this version most readily.

Odpis aktu małżeństwa z adnotacją o rozwodzie (Marriage Certificate with Divorce Annotation)

Once a Polish divorce is final, the Urząd Stanu Cywilnego (Civil Registry Office) adds a note to the original marriage record. You can ask for a certified extract of that annotated certificate (odpis aktu małżeńskiego). It is extra proof of the divorce. Some applicants send it with the decree for added weight.

Postanowienie o separacji (Separation Order) — NOT SUFFICIENT

A Polish separation order (separacja) separates the spouses in law, but the marriage still stands. Under Polish law, separated spouses are still married, so they are not free to remarry. UKVI will not take a separation order as proof that you can marry. Only a full divorce decree (orzeczenie o rozwodzie) counts.

Obtaining Certified Court Copies (Odpis) from Poland

Ask the Polish court for an odpis, a certified copy. A plain photocopy will not do. There are two kinds:

  • Odpis zwykły — the standard certified copy. It covers most UK visa needs
  • Odpis poświadczony za zgodność z oryginałem — certified as matching the original. Complex cases sometimes call for it

You can ask for an odpis by post, in person, or through the Polish consulate in the UK. It usually takes 2–6 weeks.

Which UK Visa Types Need Polish Divorce Certificate Translation?

Several UK visa routes need a certified translation of your Polish divorce decree, not just the spouse visa. Here are the four main ones:

Spouse / Partner Visa

This is the most common reason people need this translation. UKVI must confirm that the applicant and the UK sponsor were both free to marry on the wedding day. If either of you had a Polish marriage before, the decree is required.

Required when: you or your UK sponsor married in Poland before, and that marriage ended in divorce.

Settlement / ILR (Indefinite Leave to Remain)

For ILR on the family route, UKVI looks at the whole history of your relationship and marriage. You must account for any earlier marriage with translated divorce papers. That shows your current marriage was valid throughout your time on a visa.

Required when: you have an earlier Polish divorce that is not already in your UKVI file.

British Citizenship (Naturalisation)

A naturalisation application needs a complete, consistent marital history. Every earlier marriage and divorce must be documented and translated. UKVI compares your citizenship form with all your past visa applications and looks for gaps.

Required when: you are applying for British citizenship, and an earlier Polish marriage and divorce has never been sent to UKVI.

Global Talent / Skilled Worker Visa

These routes mainly look at your professional qualifications. But if you add a spouse or partner as a dependant at the same time, the freedom-to-marry rules still apply. So a Polish divorce decree translation may be needed if either of you was married before.

Required when: you add a spouse as a dependant, and either of you has an earlier Polish divorce.
