Italian Divorce Certificate Translation for UK Visa

Applying for a UK spouse visa after an Italian divorce? UKVI needs certified English translations of your Italian divorce papers. This guide covers each document type, the Italian court process, and how to get translations UKVI accepts.

Italy deals with divorce through its civil courts, and the papers are all in Italian. Were you married in Italy before? Then UK Visas and Immigration (UKVI) will want certified English translations of your divorce papers for a spouse visa, partner visa, or settlement (ILR). Knowing which documents you need, and what each one proves, saves time and helps you avoid a refusal.

UKVI Requirement: Proof of Dissolution of Previous Marriage

UKVI needs you to show that you are legally free to marry or enter a civil partnership. If you were married in Italy before, that means certified English translations of your Italian divorce documents. The translation must be complete, accurate, and done by a qualified translator. You cannot translate your own documents.

Italian Divorce Documents: Which Do You Need?

Italy issues several documents about the end of a marriage. Which ones you get depends on how and where the divorce went through. These three come up most often in UK visa applications:

Sentenza di Divorzio (Court Divorce Judgment)

This is the main divorce document in Italy. The Tribunale (civil court) issues it after the divorce case ends, whether or not it was contested. It holds the court's judgment granting the divorce and the date it became final (passata in giudicato). It works like a Decree Absolute in England and Wales. UKVI relies on it heavily as proof that the marriage has legally ended.

Estratto dell'Atto di Matrimonio con Annotazioni (Marriage Certificate Extract with Annotations)

The Comune (local civil registry) where you first registered the marriage issues this. Once the divorce is final, the Comune adds a note to the original marriage record. The extract then shows both the marriage and the divorce in one place. That makes it the most useful single document for a UK visa, because it sets out your whole marital history at once.

Dichiarazione di Stato Libero (Declaration of Single Status)

A formal statement from the Comune. It confirms that you are not married now and are free to marry again. UKVI sometimes asks for it alongside the other papers, when it wants clear proof of your current status. It expires, so get it shortly before you apply.

How Italian Divorce Becomes Legally Final: Passata in Giudicato

One Italian idea matters a lot here: passata in giudicato. It is the moment a court judgment becomes final and can no longer be appealed. In an Italian divorce, the court gives its judgment first. The divorce only becomes fully binding once that judgment has passed into res judicata, which means nobody can challenge it. UKVI caseworkers look for this date on your papers.

So the sentenza di divorzio must come with a note or stamp confirming it is passata in giudicato. Your translator has to get this legal term right in English. A word-for-word "passed into judgment" is not good enough. The correct English is "final and binding" or "the judgment has become res judicata."

Italy and the Apostille Convention

Italy is a member of the Hague Apostille Convention. The Prefettura apostilles civil documents, and the Corte d'Appello apostilles court documents. UKVI does not insist on an apostille for a visa, but it adds an extra layer of proof. If UKVI asks you to prove a document is genuine, an apostilled copy is the strongest answer.

Obtaining Italian Divorce Documents from Abroad

If you are in the UK and need your Italian divorce documents, you have a few options:

From the Comune (Municipal Registry)

  • • Contact the Comune where the marriage was registered
  • • Request the estratto dell'atto di matrimonio con annotazioni
  • • Also request the dichiarazione di stato libero if needed
  • • You can ask by post, or send someone in Italy (a relative or lawyer) on your behalf
  • • Italian citizens abroad can go through the AIRE register (Anagrafe degli Italiani Residenti all'Estero)

From the Tribunale (Civil Court)

  • • Contact the Tribunale that issued the divorce judgment
  • • Request a certified copy (copia conforme) of the sentenza di divorzio
  • • Check that the note showing passata in giudicato is on the copy
  • • The court registry (cancelleria) deals with certified copy requests
  • • Allow 2–6 weeks for Italy to send it

The Remarriage Chain: Why Multiple Documents Matter

For a UK spouse visa, UKVI must be able to follow your full marital history. Immigration advisers call this the "remarriage chain." Every past marriage needs proof that it ended. So if you married in Italy, then married again (in Italy or anywhere else) before your current relationship, you must show divorce evidence for each marriage in the chain.

The annotated marriage extract (estratto dell'atto di matrimonio con annotazioni) helps most here. It shows the marriage and the divorce note on one document, so a UKVI caseworker can follow the chain at a glance.

Frequently Asked Questions

Do I need to translate both the sentenza di divorzio and the estratto con annotazioni?

For most UK visa applications, the annotated marriage extract on its own may be enough, because it shows the marriage and the divorce note together. But UKVI may ask for clear proof of the court judgment and the date it became final. In that case you need the translated sentenza di divorzio, with the passata in giudicato note. For a spouse visa, sending both documents is safest.

Does my Italian divorce document need an apostille for a UK visa?

Usually not. A certified translation is normally enough. But if UKVI questions whether a document is genuine, an apostilled original is the strongest answer. Italy is in the Hague Convention, so you can get an apostille from the Prefettura or the Corte d'Appello.
