Spanish Divorce Certificate Translation for UK Visa

Spain uses two main divorce documents. One is the sentencia de divorcio, the court divorce judgment. The other is the certificado literal de matrimonio con nota marginal, a marriage certificate with the divorce noted on it. A UK visa application that involves an earlier marriage may need either or both.

For a UK spouse visa or settlement visa, UKVI needs proof that any earlier marriage has legally ended. If you are Spanish, or you married in Spain, you need the right Spanish divorce document with a certified English translation. Spain has two different types of divorce paperwork. Knowing which one UKVI needs, and what each one proves, helps you avoid delays.

Spain Is in the Apostille Convention

Spain has been a member of the Hague Apostille Convention since 1978. The Spanish Ministry of Justice can add a Hague apostille to official Spanish documents. An apostille confirms the document is genuine. UKVI does not always ask for one on Spanish papers. Still, an apostille on the divorce document adds a useful extra layer of proof, especially if the divorce was many years ago.

The Two Spanish Divorce Documents

1. Sentencia de Divorcio (Divorce Judgment)

The sentencia de divorcio is the court judgment that grants the divorce. It comes from the Juzgado de Primera Instancia (First Instance Court — the civil family court). It is a legal ruling that sets out the terms of the divorce. This includes the date the divorce was granted, the money arrangements, and any decisions about the children.

What it proves: that a Spanish court granted a divorce. It is the strongest divorce document.

2. Certificado Literal de Matrimonio con Nota Marginal de Divorcio

This is a certified full copy (certificado literal) of the original marriage entry in the Registro Civil. It carries a note in the margin (nota marginal) that records the later divorce. The Registro Civil adds this note to the marriage register once the court divorce judgment has been registered.

What it proves: both the marriage and the later divorce, in one document. It comes from the Registro Civil, not the court.

Which Document Does UKVI Need?

UKVI guidance does not say exactly which Spanish divorce document you must send. In practice, either one is accepted as proof of divorce. But there are some practical points to weigh up:

DocumentAdvantageLimitation
Sentencia de divorcioStrongest proof — a direct court record of the divorceCan be long (10–50 pages), and every page needs translating
Certificado literal con nota marginalShort — shows the marriage and the divorce in one documentOnly works if the Registro Civil added the note correctly
Both documents togetherMost evidence — court ruling plus civil registry recordCosts more to translate if the sentencia is long

For most UK visa applications, the certificado literal de matrimonio con nota marginal de divorcio is the easiest document to send. It is usually a single short page from the Registro Civil. It shows the original marriage and the divorce note together. If UKVI also asks for the sentencia, you can send that as extra evidence.

How to Obtain Spanish Divorce Documents

1

Identify the Registro Civil

Your marriage was registered at the Registro Civil in the town where the civil ceremony took place. If you married in church, it was registered where that marriage was recorded for civil purposes. That office is where you get the certificado literal with the nota marginal.

2

Identify the Court

The Juzgado de Primera Instancia that heard the divorce case holds the sentencia de divorcio. This court may be in a different city from the one where your marriage was registered.

3

Request Online or In Person

You can now ask for Registro Civil certificates online through the Ministry of Justice portal, or in person at the Registro Civil. Spanish nationals living abroad can also apply through the Spanish Consulate in the UK.

4

Consider an Apostille

If UKVI or your solicitor suggests an apostille, the Ministry of Justice issues them. You can ask for one at the same time as the document, or add one later.

Pre-1981 Divorces: Particular Challenges

Divorce was illegal in Spain until 1981. Civil divorce only became legal when the Ley del Divorcio (Divorce Law) came into force on 7 July 1981. This matters for UK visa applicants in several ways:

No Pre-1981 Civil Divorce

A marriage from before 1981 could only be ended by divorce after the new law started. So if a Spanish marriage seems to have ended before July 1981, it ended by death, not divorce. Check the date on any divorce document carefully.

Church Annulments

Before 1981, some Spaniards got Catholic Church annulments (nulidades eclesiásticas). These are religious, not civil. Under Spanish civil law they do not count as a legal divorce. For a UK visa, a church annulment on its own is not enough. You need a civil divorce or a civil annulment. Since 1981, civil divorce has been the normal route.

Foreign Divorces for Spain-Married Couples

Some Spaniards who married in Spain divorced in another country before 1981, where divorce was legal. Others divorced in Spain after 1981. If the divorce happened abroad and Spain later recognised it, the Registro Civil will hold a note about it. Even so, you may also need the foreign divorce document.

Older Documents and Legibility

Documents from the early 1980s, when the divorce law was new, may be handwritten or use old typefaces. Your translator must be able to read them and translate them correctly. If this applies to you, check that they have worked with old Spanish civil documents before.

The Remarriage Evidence Chain

If one or both of you have been married before, UKVI wants a full "evidence chain". This shows that every earlier marriage has legally ended. For a Spanish applicant with an earlier Spanish marriage, the chain usually looks like this:

Complete Spanish Remarriage Evidence Chain

  • Previous marriage certificate (certificado literal de matrimonio) — translated
  • Divorce document — either sentencia or certificado con nota marginal — translated
  • If death: death certificate of former spouse — translated
  • Current marriage certificate — translated

Frequently Asked Questions

My Spanish divorce sentencia is 25 pages long. Do all pages need to be translated?

Yes. Every page with real content must be translated. That covers the court's reasoning, the divorce terms, the date of the divorce, and any note confirming the judgment is final (firme or ejecutoria). The part UKVI most needs is proof that the divorce is final, and the date it became final. If you send only part of the document, UKVI may ask for the whole thing. If the sentencia is very long, think about the certificado literal de matrimonio con nota marginal instead. It does the same job in a single page.

What is a 'nota marginal' and how do I know if my marriage certificate has one?

A nota marginal (marginal note) is a note added in the margin of the original civil registry entry. It records a later legal change — here, a divorce. Ask the Registro Civil for a certificado literal, a full certified copy of your marriage certificate. If the divorce was registered properly, it will show as a note in the margin. If there is no note, the divorce may not have been registered yet. In that case you may need to register the sentencia with the Registro Civil first, then ask for the certificado.
